1. General
Shorts Industries Limited are lift equipment suppliers to the UK and Irish Lift Industries and as such only supply Complete Lifts, Lift Components and Lift Spares for installation by trained and competent Lift Engineers familiar with the equipment they are working on.

Orders for Lift Spare Parts are accepted subject to the Shorts Industries Limited Lift Spare Parts Terms and Conditions of Sale. No other conditions shall apply unless prior agreement is received in writing from Shorts.

2. Cancellation
Orders for Lift Spare Parts may not be cancelled once accepted by Shorts for any reason without the written agreement of Shorts.

At Shorts’ discretion, Orders for non-stock spare parts may only be cancelled subject to the Purchaser’s agreement to pay an amount equivalent to Shorts’ costs incurred.

3. Prices
All prices for lift spare parts quoted by Shorts, published in any Shorts’ literature or on Shorts’ website are ex works Bradford and are exclusive of VAT. Prices may change without prior notice.

Where an order is placed using the web shop, a contract is only formed when the order is acknowledged by Shorts. If an error is discovered in the web shop price, where the correct price is higher than stated in the web shop, the Purchaser will be given the option of reconfirming the order at the correct price or cancelling it. If the correct price is lower, the order will be acknowledged at the lower price.

Shorts’ minimum order value is £15.00 (excluding VAT and delivery).

4. Specification
The Lift Spare Parts are supplied by Shorts on condition that the Purchaser is satisfied that the goods are suitable for their purpose. Shorts can assist with Spare Part identification based on information provided by the Purchaser, but will not be liable for any loss or damage sustained by the Purchaser due to misdiagnosis of any reported equipment faults or misidentification of any parts.

Any and all specifications, drawings or particulars published in any Shorts’ literature, on Shorts’ website or issued in writing or by word of mouth are approximate only and are meant to present a general description of the goods. None of this material shall form part of the contract between the Purchaser and Shorts.

5. Availability
All products are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes unavailable or subject to a lead time we shall notify you as soon as possible where you will be given the option to cancel your order without charge.

6. Delivery
Deliveries of Lift Spare Parts will only be made to addresses in the UK and Ireland.

Shorts will notify the Purchaser of any Lift Spare Parts that are not in stock and will provide an estimated delivery period.

All orders received before 15.00hrs and where the part is in stock will be shipped the same day. Orders received after 15.00hrs and where the part is in stock will be shipped the next working day. The detail of Shorts’ standard delivery schedule and pricing structure can be found here.

Delivery times quoted are estimated and do not include any contractual obligation. Shorts will not be liable for any loss or damage sustained by the Purchaser or the Purchaser’s customer due to delays in delivery. The Purchaser shall not be entitled to refuse to accept late delivery.

Any damage or shortages must be notified to Shorts within 5 working days of taking delivery of the Spare Parts. Any non-arrival of goods must be notified to Shorts within 10 days of the estimated delivery date.

7. Title
Title of goods is retained by Shorts Industries Limited until payment is received in full.

8. Payment
If Shorts has not granted credit to the Purchaser, payment terms are cash with order.

Credit terms (subject to approval and at Shorts discretion) are available. If credit has been granted, the Purchaser shall pay the price of the product before the end of the month following the month in which the products are despatched. All payments must be made without any set-off, deduction or counterclaim.
VAT will be charged at the rate at the time of despatch of the goods or, if different, the basic tax point.

9. Returns
Lift Spare Parts may not be returned to Shorts for any reason without the prior agreement of Shorts and the issue by Shorts of a Returns Number.

Any Stock Parts ordered and no longer required can be returned, subject to them being in a condition such that they are fit for re-sale. They must be unused, sealed in their original packaging and complete with any manuals, certificates and delivery notes. The return request must be made within one working week of the date of delivery and the Purchaser must bear the cost of return delivery. In this instance there will be a restocking charge of the greater of £20 (plus VAT) or 10% of the sales price of the goods being returned.

Any Non-Stock Spare Parts, Software or pre-programmed Spare Parts or specially manufactured products cannot be returned under any circumstances.

Return postage remains the responsibility of the Purchaser and Shorts accept no liability for any loss or damage to returned goods in transit from Purchaser to Shorts.

10. Warranty
All Shorts’ Lift Spare Parts carry a 12 months warranty.

All Lift Spare Part warranty claims must be made in writing to Shorts. Any goods returned as faulty within the warranty period will be inspected and tested by Shorts or by the original manufacturer. Should the part be found to have a manufacturing fault, a replacement part will be despatched by Shorts. Should the part be found to have been damaged due to improper use or care or found to be not faulty, then it will be returned to the Purchaser and the Purchaser will be invoiced for the cost of testing.

If a warranty claim is made and the Purchaser requires an immediate replacement part, then a Purchase Order will be required. A replacement part will be despatched by Shorts and an invoice issued. Following testing of the faulty part, should the part be found to have a manufacturing fault, a credit note will be raised against the invoice.
Should the part be found to have been damaged due to improper use or care or found to have no fault, then it will be returned to the Purchaser and the Purchaser will be invoiced for the cost of testing.

Return postage remains the responsibility of the Purchaser and Shorts accept no liability for any loss or damage to returned goods in transit from Purchaser to Shorts.

This warranty shall only apply if, where applicable, the Lift Spare Parts have been serviced by a competent person.

Shorts’ liability under this clause constitutes its sole liability (save in respect of death or personal injury caused by negligence of Shorts) whether in contract, tort (including negligence) or otherwise in respect of any defects in the goods supplied under the contract and any warranties or conditions implied by law are hereby expressly excluded.
