Shorts Industries Ltd (Shorts) Webshop Trade Account Terms and Conditions

These terms and conditions govern our Webshop Trade Accounts.

1) Account Application and Authorisation:
You may apply for a Webshop Trade Account and, if successful, will become an authorised Webshop Trade Account Holder (Account Holder).

2) Eligibility:
A Webshop Trade Account (Account) is only available to employees of UK or Irish-based Lift Installation or Lift Maintenance companies or self-employed Lift Engineers. At Shorts' discretion, restricted non-purchase Accounts may also be approved for UK or Irish-based Lift Consultants. Shorts reserves the right to verify the information provided and, where applicable, request evidence, such as company registration number and a copy of insurance covering the named party/business for lift works, to verify their eligibility for an account.

3) Age and Authority:
All Account Holders must be 18 years or over, resident in the UK or Ireland, and have the authority to place orders on behalf of the company they represent.

4) Registration Process:
All Account Holders must provide a valid email address and complete our double opt-in registration process. This Double Opt-In process ensures the email address provided is for a valid and monitored inbox. Applications for email addresses not validated within seven days will be permanently deleted from our systems.

5) Order Acceptance:
An Account offers no guarantee that any order placed via the Webshop will be accepted. All orders are subject to our Webshop Terms & Conditions of Sale.

6) Payment Terms:
An Account is not a credit facility; all purchases must be paid for before dispatch or placed onto a Shorts Credit Account where previously agreed and in good standing.

7) Application Decline Rights:
We uphold the right at any time to decline an Account application, including, but not limited to, applications from companies or individuals not covered by Clause 2 above, those who are unable to exhibit the required levels of competency required for the safe installation of Shorts’ products, or any suspected dishonesty on the part of the Online User.

8) Promotional Offer Changes:
We may change any promotional offers at any time. We will notify you of changes by posting notices on our website and/or communicating with you.

9) Single Account Policy:
You may only hold one Account at a time. Multiple Account Holders from the same lift company must register for their Account and accept the terms and conditions.

10) Promotional Codes:
Any Promotional Code must be entered at Registration or Checkout before purchase. Promotional Codes cannot be claimed retrospectively.

11) Data Protection and Privacy:
We are committed to protecting your privacy and will only use your information following our Privacy Policy and relevant data protection laws, including the GDPR. Your data will be stored securely and processed according to our Privacy Policy, which you can view here.

12) Account Security:
You are responsible for maintaining the confidentiality of your account login details and any activities under your account. You must notify us immediately of any unauthorised use of your account or any other security breach.

13) Termination and Suspension:
We may suspend or terminate your Account immediately if you breach any terms, engage in fraudulent activities, or if required by law. We will notify you of the reasons for this when possible.
Accounts with no activity for 12 months or no online orders for three months may also be suspended or cancelled.
You can cancel your Webshop Trade Account anytime by writing to us.

14) Dispute Resolution:
In any dispute arising out of or in connection with these terms and conditions, the parties shall attempt to resolve the dispute through negotiation. If the dispute cannot be resolved by negotiation within 30 days, either party may request mediation or arbitration before pursuing legal action.

15) Modification of Terms:
We may modify these terms and conditions at any time. We will notify you of any changes by posting the updated terms on our website and/or directly communicating with you. Your continued use of the Account after such changes constitutes your acceptance of the new terms and conditions.

16) Intellectual Property:
All content on our website, including text, graphics, logos, images, and software, is the property of Shorts or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from our website without prior written consent.

17) Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed by the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18) Liability:
We will not be liable to you for anything beyond our reasonable control, including any inability to access your Account due to data processing or transmission link failures.

19) Statutory Rights:
These terms do not affect your statutory rights.
